Below you can find answers to the most frequent questions (Frequently Asked Questions).
What am I allowed to do with the tracks I have downloaded?
Downloaded tracks can be used IMMEDIATELY to privately test the synchronization with your videos and projects. In the case of paid downloads, the tracks can also be used for private listening.
REQUESTING A LICENSE you can obtain other rights (e.g. use in video, websites, etc.)
Is Lorenzo Tempesti a member of a Copyright Collecting Agency? What does this imply?
Yes, Lorenzo Tempesti is a member of SIAE, the Italian main copyright collecting agency. This means that for the songs composed by Lorenzo Tempesti it may be necessary to obtain, in addition to his direct license, a license from a collecting agency that has an agreement with SIAE (e. g. ASCAP, GEMA, etc.). NO license is required to upload videos to Youtube, since SIAE gets a global fee from Youtube that covers all the user content that contains SIAE members' songs.
What are the rights granted with the license?
With the free license you get the authorization of the author and producer to the use specified in the license: synchronization of the chosen tracks with your video production, use in shows, etc.
Can I get a license without signing up?
No, registration is compulsory.
Can I use music videos in videos of political, religious, pornographic content, etc.?
Yes, after obtaining the license and provided that the video production does not violate the laws of the country in which it is made.
The types of licenses offered do not include the use I want to make: how should I proceed?
Only some of the tracks are completely royalty-free: check the conditions in each track's page.
Can I monetize my videos on Youtube?
It depends on the tracks: it possible to monetize only the videos which contain the songs belonging to the free and free RF categories. You can still use these songs on Youtube (after obtaining the license, as for the other tracks of the rest!): you will receive a warning to include content protected by copyright that does not damage the reputation of the account and only prevents the monetization by the owner of the channel.
Is the license necessary for using the music in a private video?
The license is always necessary as the right to synchronize (pairing music with images) is a reserved right.
The only peculiarity is that if the video is viewed only in the ordinary family circle, the performance is not to be considered public and therefore is exempt from Copyright Collecting Agency fees.
Is the music contained in this site copyright-free?
Some tracks are copyright-free in the sense that the authors have died for over 70 years. However it is necessary to request a license for use in videos, regarding the producer and performer's rights.
Can I download the songs and use them for private and personal listening?
This right is only granted for songs with paid downloads from iTunes and Amazon.
Can I read the license before requesting it?
For free licenses, you can find here the general license terms, updated to the current version. In any case, at the time of subscription, you will be prompted a full reading of the license text.
For songs sold only with a commercial license, it is necessary to contact the owners of the specific library which will send you the license agreement proposal.
Can I participate in competitions with the video in which I use the music?
Yes, but in case of winning cash prizes you will have to make a donation to Lorenzo Tempesti equal to at least 15% of the prize.
I have downloaded the song from iTunes, so I can use it in my video?
Not before you have got a license . Most of the licenses are free, but you need to request them because the purchase from iTunes or other portals entitles you to private and personal use only.
Is it necessary to pay royalties to any Copyright Collecting Agency for publishing videos containing the tracks on Youtube?
It is not necessary to request a license to use the music on Youtube, as SIAE already has an agreement with the company, which regularly pays the fees.
In any case it is necessary to obtain the producer's license by following the instructions on the page of each piece.
What are my obligations when using the downloaded tracks once I have obtained my license?
The different types of licenses have different obligations. In the case of free licenses some of the main obligations are:
1. mention the author's name as specified in Annex B.
2. respect the copyright law and pay the Copyright Collecting Agency fees if they apply.
3. send a copy of the production to the author.
4. report to the author the presence of the video on websites (eg youtube).
5. fill in correctly the cue sheets related to the music used.
This list is for guidance only. The obligations of the licensee are specified in the license, which you must read completely at the time of the request. If you wish to waive any of the obligations, proceed to request a personalized license.
How much does a license cost?
The licenses of the tracks belonging to the categories Low cost, low cost RF, free and free RF are FREE!
Some costs may remain charged to the licensee: the download costs (only Low cost tracks), the Copyright Collecting Agency fees (only for Low cost and Free tracks and only for some uses, the Youtube publication is always exempt), the 15% of any cash prizes won with production.
